1. Introductory Provisions

These Terms form an integral part of any agreement concluded between the Provider and the Customer and set out the basic rules for the sale and lease of domain names and related digital services.

2. Definitions

Domain – an internet domain name, a unique digital asset registered through an accredited registrar.

Domain Sale – transfer of ownership rights to a Domain from the Provider to the Customer.

Domain Lease – granting the Customer the right to use a Domain without transfer of ownership.

Brand / Package – a combination of a Domain and accompanying digital elements (e.g., logo, graphic design, creative assets).

Delivery – the moment the Domain is deemed transferred or activated (handover of the authorization code, registrant change, registrar transfer, or DNS configuration).

3. Formation of Contract

A contract between the Provider and the Customer is formed by any of the following:

1. a) confirmation of an order placed on the Provider’s website,
2. b) payment of the purchase price or lease fee,
3. c) execution of a written agreement (including electronic form) within an individual sales or CRM process,
4. d) confirmation of contractual terms via email communication.

By paying the purchase price or confirming the order, the Customer acknowledges and agrees to these Terms.

4. Scope of Performance

The Provider undertakes to deliver the Domain or digital Package to the Customer under the agreed conditions.

In the case of a Domain Sale, ownership rights to the Domain pass to the Customer upon full payment.

In the case of a Domain Lease, the Customer is granted the right to use the Domain to the extent specified in the agreement, while ownership remains with the Provider.

Delivery is deemed completed upon:

• handover of the authorization code (EPP/Auth-ID),
  
  
• confirmation of registrant change,
  
  
• completion of inter-registrar transfer,
  
  
• or confirmation of DNS configuration.

5. Price and Payment Terms

All prices are listed excluding VAT (if applicable).

Payment is made in advance online, via payment gateway, or based on an invoice with a 14-day due date.

Rights to the Domain pass to the Customer only after full payment of the agreed price.

In case of default, the Provider is not obliged to execute the transfer.

6. Delivery Conditions

The transfer of a Domain or delivery of a digital Package is carried out in accordance with the rules of the relevant registry (e.g., CZ.NIC, ICANN).

Typical delivery time is 24–72 hours from receipt of payment, unless agreed otherwise.

The Provider is not liable for delays caused by third parties (registrars, registries, verification processes).

7. Defects and Warranty Obligations

The Provider warrants that:

• it is the legitimate holder of the offered Domain,
  
  
• the Domain is free of third-party rights,
  
  
• delivery shall be carried out according to the agreed terms.

Any technical issues will be addressed without undue delay.

8. Withdrawal and Refund Policy

8.1 Digital Nature of the Product

Domains and related digital assets constitute unique, non-returnable digital content.

Due to their nature, they cannot be returned or invalidated after Delivery.

8.2 Extinction of the Right of Withdrawal

The consumer’s right to withdraw from a contract under EU consumer law (§ 1829 of the Czech Civil Code) expires upon Delivery of the digital content.

After the Domain is transferred or activated, the Customer cannot withdraw from the contract or request a refund.

8.3 Refunds Before Delivery

Refunds may be granted only if:

• the Domain cannot be delivered for technical or registry-related reasons,
  
  
• the payment was unauthorized or fraudulent.

8.4 No “Money-Back” Claims

Domains and Brand Packages are not subject to any money-back guarantee.

By purchasing, the Customer acknowledges that the product is a digital asset with a definitive transfer.

9. Personal Data Protection

The Provider processes the Customer’s personal data only to the extent necessary for contract performance and accounting purposes, in accordance with GDPR.

The Customer has the right to access, rectify, or request deletion of personal data.

10. Dispute Resolution

Consumers may use out-of-court dispute resolution through the Czech Trade Inspection Authority (www.coi.cz).

Disputes between businesses shall be resolved before the competent court based on the Provider’s registered office.

11. Final Provisions

The Provider may amend these Terms unilaterally. The updated version becomes effective upon publication on the Provider’s website.

The contractual relationship is governed by the laws of the Czech Republic.
